  • “We,” “Us,” “Our,” “MTVT” refers to Muay Thai Visa Thailand, the international enrollment division of Sor.Dechapant Muay Thai School (Ministry of Education License No. สช.กร. 00025/2568) and Sor.Dechapant Muay Thai Camp/Gym (Sports Authority of Thailand 5-Star Professional Camp, 2025).
  • “You,” “Your,” “Client,” “Student,” “Applicant” refers to any person accessing our website or enrolling in our services.
  • “Services” means visa documentation support, Muay Thai training programs, and related assistance provided by MTVT.
  • “DTV” refers to the Destination Thailand Visa, a 5-year multiple-entry visa category introduced in 2024.
  • “ED Visa” refers to the Education (Non-Immigrant ED) visa category.
  • “Thai Authorities” includes the Ministry of Foreign Affairs, Immigration Bureau, Ministry of Education, Sports Authority of Thailand, and any other relevant Thai government agencies.
  • “Training Program” means the Muay Thai instruction provided by Sor.Dechapant Muay Thai School and Camp.
  • “Documentation Package” means the collection of documents we prepare to support your visa application.

2. ACCEPTANCE OF TERMS

2.1 Binding Agreement

By accessing https://www.muaythaivisathailand.com, submitting an application, making a payment, or using any of our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions in their entirety.

2.2 Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website with an updated “Last Updated” date. Your continued use of our services after modifications constitutes acceptance of the revised terms. We recommend reviewing this page periodically.

2.3 Capacity to Contract

You confirm that you are at least 18 years of age (or 20 years of age for DTV applications, as required by Thai regulations) and have the legal capacity to enter into this binding agreement. If you are applying on behalf of a minor for an ED Visa, you confirm that you are their legal guardian with the authority to bind them to these terms.

3. SCOPE OF SERVICES

3.1 What We Provide

MTVT, as the international enrollment division of Sor.Dechapant Muay Thai School (MOE License สช.กร. 00025/2568) and Sor.Dechapant Muay Thai Camp (SAT 5-Star Professional Camp) provides:

  • Direct enrollment in government-recognized Muay Thai training programs
  • Preparation of official documentation packages to support visa applications
  • Acceptance letters signed by our School Director with official school stamps and certifications
  • Training schedules and curriculum documentation
  • Attendance monitoring and monthly reporting (ED Visa)
  • 90-day address reporting assistance
  • Guidance on visa application procedures and Thai immigration requirements
  • Extension support for eligible visa categories

3.2 What We Do NOT Provide

We explicitly DO NOT:

  • Act as a visa agency or immigration attorney (we are an educational institution)
  • Process visa applications on your behalf (you submit directly to Thai embassies/consulates)
  • Guarantee visa approval (final decisions rest with Thai authorities)
  • Make legal representations before immigration courts or tribunals
  • Provide legal advice regarding complex immigration matters
  • Control or influence embassy processing times or decisions
  • Guarantee embassy interview outcomes

3.3 Our Authority and Credentials

We operate under the following government certifications:

  • Ministry of Education License: สช.กร. 00025/2568 (verifiable at school.opec.go.th/school/1110205090)
  • Sports Authority of Thailand: 5-Star Professional Camp certification (2025)
  • Registered Training Institution: Authorized to issue official documentation for ED Visa and DTV Visa applications

These certifications authorize us to provide enrollment services and official documentation for visa applications under Thailand’s “Soft Power” initiative for Muay Thai training.

3.4 Client Responsibilities

You are solely responsible for:

  • Submitting your visa application through official Thai government channels (thaievisa.go.th or embassy/consulate)
  • Ensuring all information provided to us and the Thai authorities is truthful, accurate, and complete
  • Meeting all Thai embassy and immigration requirements has been independently verified
  • Maintaining a valid passport with at least 6 months’ validity
  • Complying with all Thai laws, visa regulations, and work prohibitions
  • Attending required training sessions as committed in your application
  • Completing mandatory 90-day address reporting
  • Monitoring your visa expiry dates, permitted stay duration, and stamp validity
  • Departing Thailand before your permitted stay expires to avoid overstay penalties
  • Obtaining appropriate health insurance (mandatory for DTV; strongly recommended for ED Visa)

4. CRITICAL DISCLAIMERS AND LIMITATIONS

4.1 No Guarantee of Visa Approval

IMPORTANT: WE CANNOT AND DO NOT GUARANTEE VISA APPROVAL.

While we maintain a 99% approval rate over the past 12 months for complete applications with accurate information, visa decisions rest entirely with Thai embassies, consulates, and the Immigration Bureau. Approval depends on factors beyond our control, including:

  • Embassy-specific policies and interpretation of regulations (requirements vary significantly by location)
  • Immigration officer discretion at the time of application review
  • Your personal immigration history (prior overstays, visa violations, entry denials)
  • Changes to visa regulations between application submission and decision
  • Your nationality, passport type, and country of application
  • Financial verification and proof of funds assessment
  • Document authentication and background checks
  • Political, diplomatic, or security considerations

Even with complete and accurate documentation from a fully licensed institution, visa applications may be rejected.

4.2 Evolving Immigration Policies (2025-2026 Context)

Thailand’s visa enforcement has intensified significantly in 2025-2026:

DTV Visa (Introduced 2024):

  • This is a relatively new program with policies still evolving
  • Embassy requirements vary substantially by location
  • Future attendance or participation verification may be introduced
  • Immigration has increased scrutiny of all long-term visa categories
  • Policy changes can occur without advance notice

ED Visa (Enhanced Enforcement 2025):

  • Monthly attendance reporting is now required through electronic systems
  • Minimum 80% attendance per 90-day period strictly enforced
  • Immigration conducts random attendance verification checks
  • Non-compliance can result in visa revocation without appeal

General Immigration Climate:

  • Approximately 2,900 foreigners were denied entry in 2025 for visa abuse patterns
  • Officers scrutinize cumulative stay history, not just current entry
  • “Tourist visa” cycling and back-to-back entries trigger investigation
  • Overstay enforcement has become more aggressive, with higher penalties

We monitor policy changes closely but cannot predict future regulatory developments. Information provided reflects our best understanding as of the date above.

4.3 Nationality-Specific Considerations

While we accept applications from most nationalities, some countries face statistically higher rejection rates or enhanced scrutiny for long-term Thai visas. This is based on Thai government immigration data and bilateral relations, not our policies.

If you are from a country with known visa difficulties, we will inform you during the eligibility assessment and may recommend:

  • Applying from your home country rather than a third country
  • Providing additional supporting documentation
  • Consulting with an immigration attorney before proceeding
  • Considering alternative visa categories

We cannot control nationality-based approval variations and make no guarantees regarding approval likelihood based on nationality.

4.4 No Attorney-Client Relationship

Nothing in these terms creates an attorney-client relationship. We are an educational institution with government licenses to provide training and issue official documentation.

For complex legal matters regarding immigration, deportation proceedings, visa violations, or appeals, you should consult a licensed Thai immigration attorney.

5. APPLICATION REQUIREMENTS AND CLIENT OBLIGATIONS

5.1 Eligibility Pre-Assessment

Before accepting payment, we conduct a preliminary eligibility assessment based on:

  • Your nationality and passport validity
  • Current immigration status and history
  • Financial capability (500,000 THB for DTV)
  • Age requirements (20+ for DTV, any age for ED Visa with a guardian for minors)
  • Purpose of stay alignment with visa category

This assessment reflects our professional judgment, but:

  • Is not binding on Thai authorities
  • Does not guarantee approval
  • May change if new information emerges
  • Can be affected by policy changes after assessment

5.2 Accuracy of Information

You must provide complete, accurate, and truthful information throughout the process. You acknowledge that:

  • Providing false, misleading, or incomplete information may result in:
    • Visa rejection or revocation
    • Deportation and immigration detention
    • Criminal prosecution under Thai law (Immigration Act B.E. 2522)
    • Permanent bans from Thailand (1-10 years or lifetime)
    • Blacklisting by Thai immigration authorities
  • We rely entirely on your representations when preparing documentation
  • You are responsible for verifying all information before we submit documentation packages
  • Misrepresentation discovered after visa issuance may result in visa cancellation

5.3 Document Submission Timelines

You must provide all requested documents within the specified timeframes:

  • Initial Documents: Within 7 days of payment
  • Additional Documents: Within 3 days of request
  • Embassy-Specific Requirements: As specified by the embassy (varies by location)

Delays in document submission may:

  • Extend processing time beyond the estimated periods
  • Result in missed embassy application windows
  • Affect approval chances if documents expire
  • Invalidate certain refund eligibility under our Refund Policy
  • Require re-preparation of time-sensitive documents at additional cost

5.4 Financial Requirements and Proof

For DTV Applications:

You must demonstrate liquid funds of at least 500,000 THB (approximately USD $14,000):

  • Funds must be in personal savings or checking accounts in your name
  • Business accounts, investment accounts, cryptocurrency holdings, or joint accounts typically do NOT qualify
  • Most embassies require 3-6 months of continuous bank statements showing a sustained balance
  • Recent large deposits immediately before application may be questioned
  • Embassy verification standards vary by location

Sponsorship (if applicable):

If using a sponsor for financial proof:

  • Sponsor must be: parent, legal guardian, legally married spouse, or immediate family member with documented relationship
  • Sponsor must provide: sponsorship letter, proof of relationship, proof of fund transfer to your account (for some categories), and sponsor’s financial evidence
  • Not all embassies accept sponsored applications—verify requirements for your specific embassy

For ED Visa Applications:

Financial requirements are generally lower, but you must demonstrate the ability to support living expenses in Thailand during the study period.

5.5 Training Commitment and Attendance Requirements

FOR ED VISA HOLDERS (STRICTLY ENFORCED):

As of 2025, Thai education regulations require:

  • Minimum Hours: 480 hours per year (40 hours per month average)
  • Attendance Rate: Minimum 80% attendance per 90-day reporting period
  • Monthly Reporting: We report enrollment status monthly to the Ministry of Education through electronic systems
  • Verification: Immigration conducts random attendance checks; officers may request attendance records
  • Consequences of Non-Compliance:
    • Extension denial at 90-day reporting
    • Visa revocation without appeal
    • Requirement to leave Thailand immediately
    • Difficulty obtaining future Thai visas

You must treat ED Visa attendance as a legal obligation, not a suggestion.

FOR DTV HOLDERS (FLEXIBLE BUT DOCUMENTED):

DTV Muay Thai training requirements are currently more flexible:

  • Training participation should align with representations made in your visa application
  • We recommend maintaining evidence of ongoing Muay Thai practice (training photos, gym memberships, attendance records)
  • Future policy may introduce formal attendance requirements—keep documentation as protection
  • One advantage of Muay Thai Soft Power category: continuous practice for years is natural and credible (unlike medical treatment or cooking courses)

Continuing Muay Thai training periodically provides natural evidence for immigration if questioned about your reason for staying in Thailand.

6. CRITICAL WORK PROHIBITIONS (DTV HOLDERS)

6.1 Strictly Prohibited Activities Under DTV

The Alien Working Act B.E. 2551 (2008) and Immigration Act regulations strictly prohibit DTV holders from:

  • Paid coaching or teaching (including private Muay Thai lessons, fitness instruction, or online coaching for compensation)
  • Professional competition for prize money (amateur competition may be allowed; verify with immigration)
  • Sponsored social media content (monetized YouTube, Instagram, TikTok posts featuring your Thailand experience or training)
  • Commercial promotions (paid endorsements, affiliate marketing, brand partnerships conducted from Thailand)
  • Any form of employment within Thailand (remote work for foreign employers outside Thailand is the intended purpose)
  • Freelance services delivered in Thailand (even if the client is abroad, if work is performed in Thailand, it may be considered local employment)

6.2 Consequences of Working on DTV

Violations result in:

  • Immediate visa cancellation
  • Arrest and detention by immigration police
  • Criminal prosecution (fines up to 100,000 THB and/or 5 years imprisonment)
  • Deportation at your expense
  • Immigration blacklist (1-10 year ban from Thailand)
  • Difficulty obtaining visas for other countries due to a deportation record

6.3 Clarification for Remote Workers

DTV is designed for remote workers employed by foreign companies or freelancers serving foreign clients, where:

  • The employer/client is outside Thailand
  • Income is from foreign sources
  • Work is delivered online
  • No Thai company or client is involved
  • You are not displacing Thai workers

If your work situation is ambiguous, consult an immigration attorney BEFORE applying for DTV.

6.4 Social Media and Content Creation

Many Muay Thai practitioners monetize their training through social media. Be aware:

  • Posting training content is acceptable
  • Monetization (ads, sponsors, partnerships) conducted while on DTV may violate work prohibitions
  • If social media is your income source, verify compliance with an attorney
  • Immigration officers review social media; public monetization evidence can trigger an investigation

7. TAX RESIDENCY DISCLOSURE (DTV HOLDERS)

7.1 180-Day Tax Residency Rule

Under Thai tax law, individuals staying in Thailand for 180 days or more in a calendar year may be considered tax residents and subject to:

  • Thai personal income tax on income brought into Thailand
  • Tax filing obligations with the Thai Revenue Department
  • Potential double taxation (check your home country’s tax treaty with Thailand)

7.2 Our Non-Responsibility

Tax matters are outside our scope of services. We are not tax advisors. If you plan to stay in Thailand for extended periods on a DTV:

  • Consult a qualified Thai tax accountant or international tax attorney
  • Understand your home country’s tax obligations for foreign residents
  • Maintain records of income sources and Thailand entry/exit dates
  • Research Thailand-[your country] tax treaties

We are not liable for any tax consequences resulting from your stay in Thailand.

8. PAYMENT TERMS

8.1 DTV Visa Services

  • Payment Structure: 100% payment required before documentation preparation begins
  • Processing Time: Documents ready within 2-3 business days after receiving all required information; total process, including embassy review, typically 2-4 weeks (varies by embassy)
  • Non-Refundable Components: Once documents are prepared and delivered, the service fee is non-refundable except as specifically provided in Section 9
  • Embassy Fees Separate: Thai government visa fee (approximately 10,000 THB) is paid by you directly to the embassy and is never refundable

8.2 ED Visa Services

  • Payment Structure:
    • 50% payment required before documentation preparation begins
    • Remaining 50% due upon visa approval notification
  • Processing Time: Documents ready within 2-3 business days; total process, including embassy/immigration processing, typically 30-45 days
  • Non-Refundable Components: Initial 50% payment is non-refundable after document preparation, except as specifically provided in Section 9

8.3 What Processing Time Includes

Our estimated processing times cover:

  • Our internal document preparation (2-3 business days)
  • Embassy/consulate review and decision (varies: 5-45 days depending on location)

Processing times do NOT include:

  • Time required for you to gather and submit documents to us
  • Delays caused by incomplete or incorrect information
  • Embassy requests additional documentation
  • Embassy closures for holidays or maintenance
  • Immigration Bureau internal review periods
  • Government system outages or technical issues

8.4 Pricing and Currency

All prices are listed in Thai Baht (THB). Prices are locked at the time of payment confirmation. We reserve the right to modify pricing for future applications, but your confirmed booking price is guaranteed.

Payment methods:

  • Thai bank transfer (preferred)
  • International wire transfer (fees may apply)
  • Credit/debit cards (processing fees may apply)
  • Other methods as specified during checkout

9. REFUND POLICY

9.1 Refunds Governed by Our Refund Policy Page

All refunds (including eligibility, exclusions, required evidence of rejection, timelines, processing method, and any applicable administrative deductions where stated) are governed by our Refund Policy page:

9.2 Incorporation by Reference

The Refund Policy is incorporated into these Terms and Conditions by reference and forms part of the binding agreement between you and MTVT. If there is any conflict between these Terms and the Refund Policy regarding refunds, the Refund Policy controls.

9.3 Client Cooperation Required

Refund eligibility (where available) requires that you cooperate with the process, including providing requested documents accurately and on time, submitting your application and supporting documents as instructed, and supplying an official rejection notice or written decision from the relevant authority when requesting a refund.

9.4 Chargebacks and Payment Disputes

If you file a chargeback or payment dispute while a refund request is being reviewed, we may pause processing until the dispute is resolved to prevent duplicate refunds and protect both parties.

10. LIMITATION OF LIABILITY

10.1 Maximum Liability Cap

Our total liability to you for any claim arising from our services, regardless of legal theory (contract, tort, negligence, strict liability, breach of warranty, or otherwise), shall not exceed the total amount you paid directly to us for the specific services that gave rise to the claim.

This cap applies to all claims collectively, not per incident.

10.2 Exclusions from Liability

WE ARE NOT LIABLE FOR:

Immigration and Visa Matters:

  • Visa application rejections, delays, denials, or revocations
  • Changes to Thai immigration policies, regulations, or enforcement priorities
  • Embassy or consulate decisions, processing delays, or interview outcomes
  • Immigration officer discretion or subjective assessments
  • Entry denials at Thai borders or airports
  • Deportation, removal proceedings, or immigration detention
  • Overstay fines, penalties, or bans
  • Visa cancellation or revocation after approval
  • Re-entry permit issues or complications
  • 90-day reporting problems or penalties

Training and Physical Activities:

  • Personal injuries sustained during training (see separate waiver Section 13.2)
  • Accidents at training facilities or during related activities
  • Medical conditions arising from physical training
  • Injuries from failure to follow safety instructions
  • Pre-existing medical conditions aggravated by training
  • Heat exhaustion, dehydration, or altitude-related issues
  • Contagious diseases contracted at training facilities

Property, Financial, and Personal:

  • Loss, theft, damage, or destruction of personal property
  • Financial losses due to the inability to enter or remain in Thailand
  • Costs of alternative accommodations, travel, or visa applications
  • Lost wages, business opportunities, or investment losses
  • Non-refundable bookings (flights, hotels, car rentals, tours)
  • Currency exchange losses or banking fees
  • Relocation costs if unable to move to Thailand

Third-Party Actions:

  • Actions or omissions of Thai government officials at any level
  • Third-party service providers (translators, document couriers, notaries)
  • Embassy or consulate errors, delays, or miscommunications
  • Bank or financial institution problems
  • Healthcare providers or medical facilities
  • Accommodation providers or landlords
  • Thai employers or business partners

Force Majeure Events:

  • Natural disasters (earthquakes, floods, tsunamis)
  • Pandemics, epidemics, or public health emergencies
  • Political unrest, military actions, coups, or civil disturbances
  • Terrorism, war, or armed conflict
  • Government shutdowns, embassy closures, or administrative changes
  • Technology failures, cyber attacks, or system outages not caused by our gross negligence
  • Strikes, labor disputes, or transportation disruptions

10.3 Consequential Damages Waiver

UNDER NO CIRCUMSTANCES shall we be liable for consequential, indirect, incidental, special, punitive, or exemplary damages, including but not limited to:

  • Lost profits, business opportunities, or contracts
  • Loss of business reputation or goodwill
  • Emotional distress, mental anguish, or psychological harm
  • Loss of bargain or expectation damages
  • Wasted expenditures on relocation planning
  • Opportunity costs or alternative investments foregone
  • Damages to professional relationships or career prospects

This waiver applies even if we were advised of the possibility of such damages.

11. OVERSTAY PREVENTION AND IMMIGRATION COMPLIANCE

11.1 Critical Overstay Warning

OVERSTAYING IN THAILAND IS A SERIOUS CRIMINAL OFFENSE WITH SEVERE CONSEQUENCES.

How Overstay Works:

  • Overstay begins THE DAY AFTER your “permitted until” date expires (stamped in your passport at entry)
  • NOT when you leave Thailand
  • NOT when immigration notices
  • THE NEXT DAY is already an overstay

Financial Penalties:

  • Fine: 500 THB per day of overstay
  • Maximum Fine: 20,000 THB (after which longer-term bans apply)

Immigration Bans:

  • 1-90 days: Pay fine when leaving; no ban
  • 90+ days: 1-year ban from re-entering Thailand + 20,000 THB fine
  • 1+ year: 3-year ban + 20,000 THB fine + potential detention
  • 3+ years: 5-year ban + 20,000 THB fine + likely detention
  • 5+ years OR if arrested: 10-year ban + detention mandatory + deportation proceedings

If Arrested Before Voluntary Departure:

  • Arrested on the spot (police check, hospital visit, accident, random check)
  • Taken to Immigration Detention Center (IDC)
  • Bail arrangements required
  • Court appearance likely
  • Immigration blacklist even for short overstays
  • Banned from Thailand regardless of the overstay length

11.2 Understanding “Permitted Until” vs. “Visa Validity.”

This is a common source of confusion:

  • Visa Validity: How long your visa document itself is valid for (e.g., DTV is valid 5 years)
  • Permitted Until: How long you are allowed to stay on THIS ENTRY (stamped at immigration checkpoint)

Example:

  • You have a DTV valid until 2029
  • You enter Thailand on January 1, 2026
  • Immigration stamps “Permitted until June 29, 2026” (180 days)
  • You MUST leave by June 29, 2026, or apply for an extension
  • Your DTV is still valid—you can re-enter after leaving—but if you stay past June 29, you are overstaying

ALWAYS CHECK YOUR ENTRY STAMP, NOT YOUR VISA VALIDITY.

11.3 Your Sole Responsibility

You are 100% responsible for:

  • Checking your entry stamp immediately upon arrival
  • Setting multiple calendar reminders for your permitted stay expiry
  • Applying for extensions well before expiry (not last-minute)
  • Departing Thailand before an overstay occurs
  • Understanding that extensions are discretionary and may be denied
  • Not assuming automatic extensions or grace periods (there are none)

11.4 Our Limited Assistance

While we provide:

  • General guidance on extension procedures
  • Assistance with 90-day reporting
  • Document preparation for extension applications (ED Visa)

We CANNOT:

  • Monitor your individual immigration status after you enter Thailand
  • Send you personal reminders about your visa expiry
  • Guarantee extension approval (Immigration Bureau’s discretion)
  • Prevent you from overstaying
  • Represent you in overstay cases or deportation proceedings
  • Reverse immigration bans or penalties

If you overstay, you face criminal penalties. This is your sole responsibility.

11.5 If You Realize You’ve Overstayed

Under 90 days:

  • Go to the airport/border immediately
  • Pay the fine when departing
  • Do NOT wait or hope to fix it later

Over 90 days:

  • Seek legal counsel from a Thai immigration attorney immediately
  • Consider voluntary surrender at immigration (may reduce penalties)
  • Do NOT attempt to leave secretly—if caught, consequences multiply drastically
  • Understand you will likely face a ban and potential detention

12. DATA PROTECTION AND PRIVACY

12.1 Personal Information Collection

We collect and process the following personal information:

  • Identity: Full name, date of birth, nationality, passport details, photographs
  • Contact: Email address, phone number, current address, emergency contacts
  • Financial: Bank statements, proof of funds, payment information
  • Professional: Employment details, remote work arrangements (DTV)
  • Educational: Prior education history (ED Visa)
  • Immigration: Visa history, entry/exit records, prior overstays or violations
  • Health: Medical conditions relevant to training safety
  • Training: Attendance records, performance assessments, certifications

12.2 Use of Information

We use your information to:

  • Prepare visa documentation packages
  • Issue official acceptance letters and school certifications
  • Communicate regarding your application status
  • Process payments and issue receipts
  • Comply with Thai government reporting requirements
  • Maintain attendance records and submit monthly reports (ED Visa)
  • Provide training services and safety monitoring
  • Improve our services and client experience

12.3 Information Sharing

We share your information with:

Thai Government Authorities (Required by Law):

  • Ministry of Education (monthly enrollment reports for ED Visa)
  • Immigration Bureau (visa verification, 90-day reporting)
  • Sports Authority of Thailand (training program compliance)
  • Other agencies, as required by Thai law

Affiliated Entities:

  • Sor.Dechapant Muay Thai School (we are their international enrollment division)
  • Sor.Dechapant Muay Thai Camp/Gym (training operations)

Service Providers (Limited):

  • Payment processors (secure payment handling)
  • Document translation or notarization services (if required)
  • Email and communication platforms

We do NOT:

  • Sell your personal information to third parties
  • Share data for marketing purposes without consent
  • Provide information to unauthorized parties

12.4 Data Retention

We retain your information for:

  • Duration of your visa validity period (up to 5 years for DTV)
  • As required by Thai education and immigration regulations: Ministry of Education requires 5 years; the Immigration Bureau may request records up to 10 years
  • As necessary for legal compliance or dispute resolution

After retention periods expire, we securely delete or anonymize your data.

12.5 Data Security

We implement industry-standard security measures:

  • Encrypted data transmission and storage

13. TRAINING PROGRAM TERMS AND INJURY WAIVER

13.1 Physical Fitness and Medical Clearance

Muay Thai training is physically demanding and carries inherent injury risks. By enrolling, you confirm that:

  • You are in adequate physical condition to participate in vigorous martial arts training
  • You have disclosed all relevant medical conditions (heart conditions, joint problems, prior injuries, etc.)
  • You should consult a physician if you have any health concerns
  • You understand training involves striking, clinching, cardiovascular conditioning, and high-intensity activities

If you have any medical conditions, you must obtain physician clearance before training.

13.2 Assumption of Risk and Liability Waiver

BY ENROLLING IN TRAINING, YOU VOLUNTARILY ASSUME ALL RISKS associated with Muay Thai training, including but not limited to:

Common Training Injuries:

  • Sprains, strains, muscle tears, or ligament damage
  • Joint injuries (knees, ankles, shoulders, wrists)
  • Fractures or broken bones
  • Concussions, head injuries, or traumatic brain injury
  • Cuts, bruises, contusions, or abrasions
  • Nose injuries or facial trauma
  • Rib injuries from body strikes or clinching
  • Cardiovascular events (if pre-existing heart conditions exist)

Training-Related Risks:

  • Injuries from sparring or partner drills
  • Accidental strikes during pad work or bag training
  • Exhaustion or heat-related illness
  • Exacerbation of pre-existing medical conditions
  • Injuries from equipment failure
  • Slip, trip, and fall injuries at facilities

YOU EXPRESSLY WAIVE AND RELEASE any claims against MTVT, Sor.Dechapant Muay Thai School, Sor.Dechapant Muay Thai Camp/Gym, our trainers, staff, affiliates, and other students for training-related injuries, EXCEPT in cases of:

  • Gross negligence (reckless disregard for your safety)
  • Willful misconduct (intentional harm)
  • Fraud or criminal conduct

This waiver is comprehensive and applies to all training activities, including running, conditioning, pad work, bag training, clinching, sparring, and any gym activities.

13.3 Insurance Requirement and Recommendation

For DTV Holders:

  • Health insurance is MANDATORY with minimum coverage of 500,000 THB for medical treatment in Thailand
  • Insurance must be valid for the entire visa validity period
  • Failure to maintain insurance may affect visa renewal or extension

For ED Visa Holders:

  • Health insurance is strongly recommended, but not legally required by immigration
  • Recommended minimum coverage: 1,000,000 THB for comprehensive medical care

Additional Recommended Coverage:

  • Sports injury coverage (Muay Thai-specific if available)
  • Emergency medical evacuation to the home country
  • Dental coverage for training-related facial injuries
  • Hospital cash benefits

Thailand has high rates of traffic accidents and tropical diseases. Comprehensive health insurance is essential for safety and financial protection.

We can provide referrals to Thai insurance agents upon request.

13.4 Training Rules and Code of Conduct

You must:

  • Follow all instructor directions and safety guidelines immediately and without question
  • Use provided safety equipment properly (gloves, shin guards, mouthguards, hand wraps)
  • Respect other students, trainers, and gym staff
  • Maintain appropriate personal hygiene (shower before training, clean gear, trim nails)
  • Refrain from training under the influence of alcohol or drugs
  • Report injuries, health concerns, or equipment problems immediately to trainers
  • Respect gym traditions, including the Wai Khru ceremony and cultural practices

Violations may result in:

  • Verbal warning
  • Temporary suspension from training
  • Permanent expulsion without refund
  • Visa documentation support termination (for serious violations)

13.5 Training Facility Terms

  • Training schedules and class times are subject to change
  • Facilities may close temporarily for maintenance, events, holidays, or emergencies
  • No refunds or extensions provided for temporary closures
  • Equipment availability is first-come, first-served during busy periods
  • We reserve the right to limit class sizes for safety

14. INTELLECTUAL PROPERTY

14.1 Ownership

All content on our website and in our materials, including:

  • Text, articles, and written content
  • Graphics, logos, and visual designs
  • Photographs and videos
  • Software and technical implementations
  • Training curriculum and methodology
  • Proprietary documentation formats

Is the exclusive property of MTVT, Sor.Dechapant Muay Thai School, or our licensors, and is protected by Thai and international copyright, trademark, and intellectual property laws.

14.2 Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to:

  • Access and view our website for personal evaluation of our services
  • Download and print the documents we provide to you for your visa application
  • Use our documentation as authorized for visa submission

14.3 Restrictions

You may NOT:

  • Reproduce, distribute, modify, or create derivative works from our content
  • Use our content for commercial purposes without written permission
  • Remove copyright, trademark, or proprietary notices from materials
  • Frame, embed, or deep-link to our website content without permission
  • Use automated systems (bots, scrapers, robots) to access our website
  • Reverse engineer or extract source code from our platforms
  • Share our proprietary curriculum or training methods with third parties
  • Use our school name, logos, or certifications without authorization

15. ACCEPTABLE USE POLICY

15.1 Prohibited Activities

You agree NOT to:

Fraud and Misrepresentation:

  • Provide false, misleading, fraudulent, or incomplete information
  • Forge documents or signatures
  • Impersonate another person or entity
  • Use stolen or fraudulent identity documents
  • Misrepresent your purpose of visit to Thailand

Illegal Activities:

  • Use our services to facilitate visa fraud or immigration violations
  • Engage in activities that violate Thai law or your home country’s laws
  • Participate in criminal enterprises or money laundering
  • Support human trafficking, drug trafficking, or organized crime

Abuse and Misconduct:

  • Harass, threaten, intimidate, or abuse our staff or other clients
  • Make discriminatory, racist, or offensive statements
  • Disrupt training sessions or gym operations
  • Damage property or equipment
  • Engage in violence or threatening behavior

Technical Violations:

  • Interfere with website operations or security systems
  • Attempt unauthorized access to our systems or databases
  • Upload malicious code, viruses, or harmful content
  • Launch denial-of-service attacks
  • Bypass security measures or access controls

15.2 Consequences of Violations

Violations may result in:

  • Immediate termination of all services without refund
  • Revocation of all issued documentation
  • Reporting to Thai authorities (immigration, police, or relevant agencies)
  • Legal action for damages, injunctive relief, and costs
  • Cooperation with law enforcement investigations or prosecutions
  • Immigration notification if criminal activity or visa fraud is suspected

We have a zero-tolerance policy for fraud, violence, and illegal activities.

16. DISPUTE RESOLUTION

16.1 Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles.

16.2 Jurisdiction

Subject to Section 16.5 (consumer protection exceptions), you agree that any disputes arising from these terms or our services shall be resolved in the courts of Bangkok, Thailand. You consent to the personal jurisdiction and venue of these courts.

16.3 Informal Resolution Attempt (Mandatory)

Before initiating any formal legal proceedings, arbitration, or court action, you must:

  1. Contact us at [email protected] with a detailed description of the dispute
  2. Allow us 15 business days to investigate and respond
  3. Engage in good-faith negotiations to resolve the matter

Failure to attempt informal resolution may result in dismissal of formal claims.

16.4 Arbitration (Optional)

If informal resolution fails, either party may elect binding arbitration:

  • Arbitration Body: Thailand Arbitration Center (THAC)
  • Location: Bangkok, Thailand
  • Language: English or Thai as mutually agreed (or as determined by arbitrator if parties cannot agree)
  • Rules: THAC Arbitration Rules (current version)
  • Decision: Final and binding; limited grounds for appeal under Thai law
  • Costs: Each party bears its own attorney’s fees; arbitration fees are split equally unless the arbitrator awards costs to the prevailing party

16.5 Consumer Protection Exceptions

If you are a resident in a jurisdiction with mandatory consumer protection laws that provide:

  • The right to sue in your local courts
  • Restrictions on jurisdiction or arbitration clauses
  • Mandatory cooling-off periods or refund rights

Those laws may supersede Sections 16.2 and 16.4 to the extent they are mandatory and cannot be waived. We do not waive your mandatory consumer protection rights.

Common jurisdictions with such laws include EU member states, Australia, New Zealand, and some US states.

16.6 Class Action Waiver (Where Enforceable)

To the extent permitted by applicable law, you agree to resolve disputes individually and waive any right to:

  • Participate in class actions
  • Serve as class representative
  • Join in consolidated or collective proceedings

This waiver may not be enforceable in jurisdictions with laws prohibiting class action waivers (e.g., EU, Australia). Where unenforceable, this provision is severed, and the remaining terms continue.

16.7 Attorney’s Fees and Costs

In any legal proceeding or arbitration, the prevailing party shall be entitled to recover:

  • Reasonable attorney’s fees
  • Court or arbitration costs
  • Expert witness fees
  • Investigation and document production costs

From the non-prevailing party.

17. GENERAL PROVISIONS

17.1 Entire Agreement

These Terms and Conditions, together with:

Constitute the entire agreement between you and MTVT regarding your use of our services and supersede all prior or contemporaneous agreements, communications, proposals, or understandings, whether oral or written.

17.2 Severability

If any provision of these terms is found to be unenforceable, invalid, or contrary to applicable law by a court or arbitrator:

  • The unenforceable provision shall be severed (removed)
  • The remaining provisions shall continue in full force and effect
  • The unenforceable provision shall be reformed to the minimum extent necessary to make it enforceable while preserving the intent

17.3 Waiver

Our failure to enforce any provision, or delay in enforcement, does not constitute a waiver of that provision or any other provision. Waivers must be:

  • In writing
  • Signed by our authorized representative
  • Specific to the provision waived

No waiver of any provision shall constitute a waiver of any other provision or of the same provision on another occasion.

17.4 Assignment

You may NOT assign or transfer your rights or obligations under these terms without our prior written consent.

We may assign our rights and obligations:

  • To any affiliated entity (Sor.Dechapant Muay Thai School or Camp/Gym)
  • In connection with a merger, acquisition, or sale of assets
  • To any successor in interest

17.5 Survival of Terms

The following provisions shall survive termination of these Terms and Conditions or your use of our services:

  • Limitation of Liability (Section 10)
  • Indemnification (if any)
  • Intellectual Property (Section 14)
  • Dispute Resolution (Section 16)
  • Governing Law and Jurisdiction (Section 16.1-16.2)
  • Any provisions that by their nature should survive

17.6 Force Majeure

We are not liable for failure or delay in performing obligations due to circumstances beyond our reasonable control, including but NOT limited to:

Clearly Unforeseeable Events:

  • Natural disasters (earthquakes, floods, tsunamis, typhoons)
  • Pandemics or public health emergencies (e.g., COVID-19 level events)
  • War, terrorism, invasion, or armed conflict
  • Government-ordered shutdowns or closures
  • Riots, civil unrest, or insurrection
  • Strikes or labor disputes affecting essential services
  • Major technology failures (internet backbone outages, DNS attacks)

IMPORTANTLY, force majeure does NOT include:

  • Routine Thai visa policy changes (these occur regularly and are foreseeable in our industry)
  • Embassy processing delays
  • Normal bureaucratic changes
  • Economic conditions
  • Predictable seasonal changes

During force majeure events, our obligations are suspended for the duration of the event. If the event continues for more than 60 days, either party may terminate the agreement and we will refund a pro-rata portion of unused services.

All notices under these terms must be in writing and sent to:

These Terms and Conditions are provided in English. If translated into other languages for convenience:

  • English version controls in case of conflict or ambiguity
  • Translations are for reference only
  • Legal interpretation is based on the English text

17.9 Headings and Formatting

Section headings are for convenience only and do not affect the interpretation or legal meaning of provisions.

17.10 Third-Party Beneficiaries

Sor.Dechapant Muay Thai School and Sor.Dechapant Muay Thai Camp/Gym is expressly intended as a third-party beneficiary of these terms and may enforce provisions directly.

No other third parties have rights under these terms.

18. SPECIFIC ACKNOWLEDGMENTS

By accepting these Terms and Conditions, you specifically acknowledge and agree that you have read, understood, and accept the following critical points:

Visa Approval Not Guaranteed: Final decisions rest with Thai embassies and immigration; we cannot control outcomes despite our 99% approval rate for complete applications

Overstay is Serious: You are solely responsible for monitoring your permitted stay and departing before expiry; overstay results in fines, bans, and potential detention

Work Prohibited on DTV: DTV holders cannot work, teach, coach, or engage in paid activities in Thailand; violations result in deportation and criminal charges

Tax Residency Rules: Staying 180+ days/year may trigger Thai tax obligations; consult a tax professional

Training Carries Injury Risks: Muay Thai training involves inherent injury risks; you assume all risks and waive claims except for gross negligence

ED Visa Requires 80% Attendance: ED Visa holders must maintain 80% attendance per 90-day period; we report monthly to the Ministry of Education

We Are Not Immigration Lawyers: We are an educational institution; for legal advice, consult a licensed attorney

Refunds Governed Separately: Refund eligibility, exclusions, and process are governed by our Refund Policy: https://www.muaythaivisathailand.com/refund-policy/

Our Liability Is Capped: Maximum liability is limited to the fees you paid to us for services

You Must Provide Accurate Info: False information results in visa rejection, criminal prosecution, and bans

Insurance Mandatory for DTV: Health insurance with 500,000 THB coverage required for the entire visa period

Bangkok Jurisdiction: Disputes resolved in Bangkok courts (subject to your local consumer protection laws if mandatory)

Policy Changes Are Foreseeable: Thai visa policies change regularly; we monitor but cannot predict all changes

You Have Reviewed Our Credentials: We are licensed by the Ministry of Education (สช.กร. 00025/2568) and recognized by the Sports Authority of Thailand (5-Star Professional Camp)
